3. Coaching Services Terms

Service Delivery

• Coaching sessions are conducted via video call or phone call as agreed
• Session materials and content are confidential and proprietary
• Punctuality is expected; late arrivals will result in shortened sessions

Client Responsibilities

• Provide accurate and complete information
• Attend scheduled sessions or provide reasonable notice for cancellations
• Maintain confidentiality of proprietary coaching materials and methods
• Take responsibility for implementing insights and strategies discussed
• Inform your coach of any changes in circumstances that may affect your coaching

Session Recording Policy

• Sessions are not recorded without explicit written consent from all parties
• If recording is agreed upon, recordings are solely for the client’s personal use
• Recordings may not be shared, distributed, or used for any commercial purpose

4. Intellectual Property

All content on this Site, including text, images, logos, videos, coaching materials, proprietary methodologies, and other materials, is the property of Clear Path Forward Coaching, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Usage Rights

Without prior written permission, you may not:

• Reproduce any content from this website for commercial purposes
• Distribute proprietary materials to third parties
• Use content to create derivative works
• Remove or alter any copyright, trademark, or other proprietary notices

Permitted Sharing

You may:

• Share links to our blog posts and public content with proper attribution

Client Materials

Any materials specifically created for you during coaching sessions remain your property, but our coaching methods, frameworks, and proprietary processes remain our intellectual property.

5. Payment and Refund Policy

Payment Terms

• Payment is due as outlined in your coaching agreement
• All fees are non-refundable except as specifically stated in your service agreement
• We reserve the right to suspend services for non-payment

Cancellation Policy

• Cancellation of any Service Agreement will be accepted only by email within 24 hours of signing your agreement
• Repeated late cancellations of individual sessions may result in service termination
• Refund policies are outlined in individual service agreements

6. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available” without any warranties, express or implied. Clear Path Forward Coaching, LLC does not guarantee that the Site will be:

• Error-free, secure, or uninterrupted
• Free from viruses or other harmful components
• Accurate, complete, or current
• Suitable for your purposes

Coaching Disclaimer

• Coaching services are not therapy, counseling, or medical treatment
• Coaching services do not constitute any type of advice on personal matters
• Results cannot be guaranteed and may vary by individual
• You are responsible for your own decisions and actions

7. Limitation of Liability

To the fullest extent permitted by law, Clear Path Forward Coaching, LLC shall not be liable for any damages arising from your use of the Site or coaching services, including but not limited to:

• Personal injury or property damage

Our total liability shall not exceed the amount you paid for services in the 12 months preceding the claim.

2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in New Mexico
3. Class Action Waiver: You agree not to participate in class action lawsuits against us

14. Severability

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
